This website is maintained by José Augusto de Lima Prestes, Attorney enrolled with the Brazilian Bar Association, São Paulo Chapter (OAB/SP), under No. 239,104, with professional offices at Rua Comendador Tórlogo Dauntre, 74, Suite 1207, Cambuí, Campinas – São Paulo, Brazil, 13025-270, email: contato@guto.adv.br (the Controller), and its purpose is to present institutional information, practice areas and legal content of an informative nature.

Your privacy matters. This Policy explains, clearly and objectively, how information may be processed when you access this website, in accordance with Law No. 13,709/2018 (the Brazilian General Data Protection Law – LGPD).

Governing language. This is a courtesy translation, provided for the convenience of readers who do not read Portuguese. The Portuguese-language version published on this website is the sole binding version and governs in all respects. In the event of any divergence, discrepancy or conflict of interpretation between the two texts, the Portuguese version prevails. This Policy is governed by Brazilian law, and any dispute arising from it is subject to the Brazilian courts.

What personal data is collected, for what purposes and on what legal basis

This website follows the principle of necessity, processing only the data strictly required for its institutional purposes.

As a rule, this website does not collect personal data directly.

Processing occurs only in the situations below:

1.1 Contact by email

If you make contact through the address contato@guto.adv.br, the data you voluntarily provide (such as name, email address, telephone number and the content of your message) will be used solely to respond to your enquiry.

Purpose
Responding to enquiries, providing clarifications, and handling professional contacts.
Legal basis
Performance of preliminary steps relating to a prospective professional relationship (LGPD, art. 7, V) and the legitimate interests of the controller (LGPD, art. 7, IX).

You are advised not to send sensitive personal data in a first contact, unless it is strictly necessary for a preliminary assessment of the matter.

1.2 Technical access records (logs)

As occurs with any website on the internet, the server automatically records technical information, such as:

  • IP address;
  • Date and time of access;
  • Browser type and operating system;
  • Pages accessed.

This data is not used for commercial purposes or for individualized monitoring; it is processed solely to ensure the security, stability and functioning of the website.

Security, incident prevention and technical maintenance.
Legal basis
Legitimate interests of the controller (LGPD, art. 7, IX) for the security, stability and technical maintenance of the website; and a legal obligation only where retention is required by applicable law.

1.3 Data retention

  • Data sent by email: retained only for as long as necessary to handle the request, conduct preliminary discussions, or comply with legal and ethical obligations applicable to the professional activity.
  • Technical access records (logs): stored for the statutory minimum period of six (6) months under the Internet Civil Rights Framework, and may be retained for longer where necessary for security purposes, investigation of incidents, or compliance with legal obligations.

1.4 Cookies

At present, this website does not use marketing, advertising or behavioral tracking cookies.

Only cookies strictly necessary to the technical operation of WordPress may be used, with no commercial purpose and without monitoring visitors.

Should additional cookies be used in the future (for example, for access statistics), this Policy will be updated and, where applicable, the user’s consent will be requested.

02 · Third parties and security

Third-party content and resources

Browsing this website loads no resources from external providers. The typeface is hosted on this domain; no third-party services are used for fonts, maps, video, audience measurement or social media widgets.

In the public loading of the pages, we did not identify external resources that result in an international transfer arising from browsing. Processing by any providers of external resources is subject to their respective privacy policies. If the controller starts carrying out international transfers of personal data, this Policy will be updated to state the method, purpose, duration, destination, responsibilities and applicable security measures, in accordance with current law.

Should any external resource be adopted, this Policy will be updated before it comes into use, identifying the provider, the purpose and the legal basis and, where required by law, the user’s consent will be requested.

2.1 Plugins and additional functionality

The website runs on the WordPress platform and integrates specific tools for technical management and administrative security:

  • Google Site Kit: an administrative tool for monitoring website performance through Google Search Console;
  • Optimization and caching tools: used to ensure performance and the correct execution of the website’s code.

At present, no data is actively collected for statistical or marketing purposes through these plugins. Should functionality involving the transmission of data to third parties be enabled, this Policy will be updated and, where required by law, the user’s consent will be requested.

2.2 With whom your data is shared

This website does not share personal data for commercial or advertising purposes.

Personal data may be processed by technology infrastructure providers (such as hosting services) solely to ensure the operation, security and maintenance of the website.

2.3 Security measures

Reasonable technical and administrative measures are adopted to protect the information processed, including, among others:

  • Use of a secure connection (HTTPS);
  • Restricted control of administrative access;
  • Periodic updating of WordPress, themes and plugins;
  • Security good practices appropriate to the nature and purpose of the website.

Your rights as a data subject

Under the LGPD, you may at any time exercise the following rights:

  • Confirmation that processing is taking place;
  • Access to your data;
  • Correction of incomplete, inaccurate or out-of-date data;
  • Anonymization, blocking or deletion of unnecessary or excessive data;
  • Data portability, where applicable;
  • Information about data sharing;
  • Withdrawal of consent, where consent is the applicable legal basis;
  • Objection to processing, where processing is carried out on the basis of legitimate interests, under art. 21 of the LGPD.

Requests will be handled within the deadlines and under the conditions provided by the LGPD and applicable regulations. For requests for confirmation of the existence of processing or access by means of a clear and complete statement, the maximum period of fifteen (15) days under art. 19(II) of the LGPD will apply. Where a specific rule applicable to the controller provides otherwise, that deadline will prevail.
